Nevada Foreclosure Help

State of Nevada Foreclosure Mediation Program

The Foreclosure Mediation Program allows homeowners to sit down with mortgage lenders, under the leadership of trained mediators, to discuss alternatives to foreclosure.  Mediation is a process of give and take and the parties must negotiate in good faith.  A mediator does not have the authority to order a resolution or an action, as a judge in a court case would, but may be able to help the parties reach a mutually beneficial agreement. Under Nevada law, the program is open to homeowners of owner-occupied houses who receive foreclosure notices that were filed after July 1, 2009.  Persons who received foreclosure notices filed before that date can join the mediation program only if their lenders agree.

Foreclosure Help for Renters

Renters are hurt by the foreclosure situation, too. If a landlord rents out a home or other property and is facing foreclosure, the tenant may not be allowed to stay on the property. Also neither the landlord nor the bank is legally obligated to let the tenant know about the foreclosure. Most of the time, the renter is told about the foreclosure when the party is being told to leave the property. Many times, tenants who are on a fixed income and who are evicted on short notice may have a lot of trouble finding another place to live. Plus, they may not have the finances for the move. A tenant may have trouble coming up with the security deposit for a new place to live and they may never get back the security deposit from the foreclosed landlord. Some people have continued to pay the landlord rent even though the landlord does not own the property anymore.

How to Avoid Foreclosure Scams

A fairly new and dangerous threat has arisen for homeowners who have fallen behind on their mortgage payments and may be at risk of opportunistic companies. They often refer to themselves as a foreclosure consultant, mortgage consultant, and market themselves as a foreclosure service, foreclosure rescue agency or loan modification company. They count on homeowners being vulnerable and desperate. These companies claim they can assist homeowners facing foreclosure with options that allow them to keep their property, refinance or modify an existing mortgage, repair credit or help buy more time. In reality, these options are intended to convince you to take the wrong steps so they can take your money and possibly your home. Remember the old saying, If it sounds too good to be true, it probably is.
